CAM-AMCHAM publishes new mediation rules

On August 1, 2025, the new Mediation Rules of the Arbitration and Mediation Center of the American Chamber of Commerce for Brazil (CAM-AMCHAM) came into effect.

The revised text updates provisions regarding the request and conduct of proceedings, sets out the allocation of responsibilities among the Secretariat, mediators, and, when necessary, the Advisory Board, and introduces mechanisms for adapting the rules in exceptional circumstances, such as disputes involving public entities.

Among the main innovations, the following stand out:

(i) Mandatory electronic filing: all requests, communications, filings, and actions taken by mediators must be submitted exclusively by electronic means.

(ii) Shorter deadline for appointing the mediator: the parties now have only 5 days to jointly appoint the mediator. In the absence of consensus, the Secretary-General, with the endorsement of the Advisory Council, will make the appointment.

(iii) Flexibility in the timeline for completion: unlike the previous version, the new Regulation does not impose a fixed deadline for the conclusion of the mediation (previously 45 days), allowing the schedule to be adjusted on a case-by-case basis, depending on the complexity of the dispute and the dynamics between the parties.

With respect to confidentiality, the rules reinforce the obligation of all parties, mediators, and the Secretariat to maintain strict confidentiality regarding all work carried out within the proceedings, while expressly outlining exceptions in specific cases, particularly when public entities are involved or when disclosure is mandated by a court order.

The new provisions apply to all mediation proceedings initiated on or after August 1, 2025.
